In Andorra, debt collection (col·lecció) consists of two different trajectories: an amicable procedure and judicial debt collection.
An amicable or extrajudicial procedure involves all efforts to collect the outstanding invoice before going to court. This includes sending payment reminders and late payment notices. In the vast majority of cases, an amicable debt collection is sufficient to collect your claim.

Extrajudicial debt collection
During the out-of-court phase of the collection process, we contact your debtor and send payment reminders. For many debtors, a letter from a debt collection agency is sufficient to prompt payment.
Additionally, we make phone calls and send emails and WhatsApp messages. This ensures that your debtor is informed about the outstanding debt, which gives them the opportunity to rectify this. When necessary, we do this in Catalan (the official language in Andorra).
In total, we contact your debtor 16 times over a period of 3 weeks. During this process, we gradually increase the pressure. The tone becomes firmer and more compelling.

Judicial procedure

Small claims
If you have a claim under 5000 euros, we can use the European Small Claims Procedure (ESCP). This procedure involves all EU Member States (except Denmark) and aims to simplify the recovery of cross-border claims. The ESCP is available if you are owed money by another company, organization, or customer.
For this, we can file your claim with the court in your country. The court will forward the claim to your debtor, who then has 30 days to respond. The court may request more information or schedule a hearing. The procedure is almost entirely digitally, and the hearing takes place through a video call.
Ultimately, the court where you have filed the claim will make a decision. This judgment is enforceable in Andorra. We can then engage a bailiff in Andorra to enforce the court’s judgment.
Claims of more than 5000 euro
If you have a claim above 5000 euros, we cannot use the European Small Claims Procedure. We must file a civil case in the Andorran court (tribunal de batlles). This court handles cases at first instance.

For this, we only need to submit a few standard forms to the court in The Hague. The judge will then issue a payment order. If your debtor does not respond within 30 days, we can hire a bailiff in Andorra. They can seize assets from your debtor with the European Payment Order.

Arbitration

Interim attachment in Andorra
To prevent your debtor from quickly disposing of his assets while the case is in court, it is possible to take interim measures.
