Debt collection service guide

Under the Wet kwaliteit incassodienstverlening, the Besluit kwaliteit incassodienstverlening, and the Regeling kwaliteit incassodienstverlening, debt collection agencies are required to proactively inform you about your rights and obligations. This information sheet outlines your rights and responsibilities in detail.

Debt collection agencies affiliated with NowID are accessible both in person and by phone. They offer the option to schedule a physical appointment at their office for services such as obtaining information, submitting documents, or making (card) payments. Please schedule your appointment in advance.

Why am I receiving a payment reminder?

You have received a payment reminder because a party claims that you owe a sum of money and have not paid the requested amount despite previous reminders. The reminder provides detailed information about the claim.

The debt collection agency can offer further clarification on how the claim was established. For any questions regarding the claim, you can contact the collection agency directly.

Payment options

You have several payment options available:

  1. iDEAL
    Prefer to pay via iDEAL? Contact the debt collection agency to request a personalized iDEAL payment link. This secure link allows you to complete your payment quickly and safely.

  2. Bank Transfer
    Want to handle the payment yourself? Use your online banking platform to transfer the due amount directly to the debt collection agency’s bank account.

  3. Cash Payment
    While bank transactions are preferred, cash payments can be arranged if necessary. Contact the debt collection agency to schedule an appointment. Note that you’ll be required to provide a declaration of the cash’s origin. The agency will document the details of this verification process in their records.

I would like to arrange a payment plan

Under the law, creditors are not obligated to accept a payment plan (Article 6:29 of the Dutch Civil Code). However, debt collection agencies affiliated with NowID strive to encourage their clients to agree to realistic payment plans that consider your financial situation.

To discuss the possibility of a payment arrangement, contact the debt collection agency directly. Be prepared to provide an overview of your income, expenses, and debts, as this information may be requested.

I dispute the claim

If you dispute the claim, you can notify the debt collection agency. Once you do so, the collection process will be paused. The agency will then contact the creditor to discuss your dispute.

You will receive a response from the debt collection agency or their client within a reasonable timeframe regarding the outcome of your dispute.

I have multiple debts

Managing multiple debts can feel overwhelming, but taking control of your outstanding accounts is essential. There are many online resources offering advice, tips, and tools to help you regain control of your finances. Visit www.nibud.nl and www.zelfjeschuldenregelen.nl for valuable tips and tools.

If your debt situation has become unmanageable, contact your local municipality for help. They can provide advice or assist with debt mediation or debt restructuring applications. The municipality will assess whether they can support you through a debt settlement process known as an amicable procedure. Learn more about this option.

I have a complaint

Debt collection agencies affiliated with NowID strive to provide quality service. However, it is possible that issues may arise. If you have a complaint about their service, you should notify the agency directly. They will process your complaint in accordance with the standard complaints procedure, which can be found on their website. Complaints can be submitted in writing via post or email.

If you are not satisfied with how your complaint was handled, you have the option to escalate it to Incassoklacht.nl. They will address the dispute through their resolution procedure. Learn more about this process here.

Processing of personal data

For full transparency, we inform you that the data you provide in connection with the underlying agreement(s) will be included in the records maintained by the debt collection agencies. These records are kept for the purpose of managing relevant information related to the collection of claims. The General Data Protection Regulation (GDPR) applies to these records.

If you wish to have your personal data deleted, send an email or letter to the organization. Specify which data you would like to have removed. You can use the sample letter for data removal provided by the Dutch Data Protection Authority (Autoriteit Persoonsgegevens). Access the sample letter here.

Please note, in certain cases, the debt collection agency is not required to delete your data—for example, if there is still an outstanding claim. Learn more about these conditions here.

Voluntary cooperation

You are not obligated to speak with the debt collection agency or allow them into your home. You have the right to end a conversation with a debt collector at any time. However, terminating the conversation may have consequences (see: What happens if I don’t pay?).

What happens if I don’t pay?

If you fail to settle the claim, the creditor may choose to initiate legal proceedings. In this case, your file will be handed over to a bailiff. You can find more information about this procedure and its potential consequences here.
